Departing Commish Simington was vocal about questioning the legality of monetary fines for pirate operators.

I'm trying to figure out what's behind all these resignations.  I sense that it's either A) they don't want to be part of the FCC weaponization going on (See also: CBS, CPB/NPR/PBS, Verizon/Charter merger, Echostar inquiry) or B) they see an opportunity to work outside the FCC to broker deals with this administration where everything is for sale (See also: Ajit Pai).

I could also be that more cuts are coming.  It's always better to resign than be asked to leave.

The number of FCC commissioners is codified in law.  Not to be "that guy" who's a wannabe attorney, but it's in 47 U.S. Code § 154.

Either way, two FCC Commissioners is still two too many.
“I am often asked how radio works. Well, you see, wire telegraphy
is like a very long cat. You yank his tail in New York and he
meows in Los Angeles. Do you understand this? Now, radio is
exactly the same, except that there is no cat.”
